Yes there was an organization just like IV which was instrumental in getting the AC21 provision. I just don't recollect the name probably IV core folks can provide more details.
Those time were different economy was booming and the anti-immigrants orgs esp against legal folks were non existent. Moreover EB folks had big uncertainty after 6yr clock on H1 expires. But now it is different, EB folks are busy tracking receipts and are happy with EAD and AP. SO who cares about rallying for a bill/amendment?
Visa numbers have been recaptured in the past (year 2000, I think).
Do we know more details on how this happened? Who worked for this and what did they do to make their efforts successful?
Same with the AC21 provision that allows changing jobs after 180 days. That is a huge accomplishment for whoever worked to make it happen.
Perhaps we can borrow some of their wisdom.

Every visa bulletin there is some information of the coming months processing that needs to be interpreted. The Oct 08 bulletin talks about the following:
http://travel.state.gov/visa/frvi/bulletin/bulletin_4357.html
E. EMPLOYMENT VISA AVAILABILITY
Item E of the May 2008 Visa Bulletin (number 118, volume VIII) indicated that many Employment cut-off dates had been advancing very rapidly, based on indications that the Citizenship and Immigration Services (CIS) would need to review a significantly larger pool of applicants than there were numbers available in order to maximize number use under the FY-2008 annual limits. That item also indicated that if the CIS projections proved to be incorrect, it would be necessary to adjust the cut-off dates during the final quarter of FY-2008. The CIS estimates have proven to be very high resulting in: 1) the unavailability of all Employment Third preference categories beginning in July, 2) the unavailability of numbers for China and India Employment Second preference adjustment of status cases during September, and 3) the establishment of many October Employment cut-off dates which are earlier than those which applied during FY-2008.
Little if any forward movement of the cut-off dates in most Employment categories is likely until the extent of the CIS backlog of old priority dates can be determined. It is estimated that the FY-2009 Employment-based annual limit will be very close to the 140,000 minimum.

Looks like in majority end july through August are pending the receipt of AP not to say some of the guys have still got it but they are from various service centers. Very inconstent. This is a document that has no accountability to be completed by X amount of time but we have all paid fees for it. Come vacation time and no AP, we will have to make the trip without the document. Its not that one decides to go to vacation every month. This is a losing deal for us. How do we address this delay? Infopass does not help I was told unless you decide to lie wholesale.

Search the address on Google, make a call & just make one visit with the printout of the Congresswoman's letter ( downloaded from IV home page) & copy of WSJ news & EB Bulletin & reversal memo on 2nd July
It is easy
In fact these Congressman office staffs are sitting idle like me ( may be you) . They are really happy to receive someone like you.
Trust me, I am not joking .....

Is more or less what I've been vouching for in the past.
You pay the dues, you get benefits.
Just like any other organization, since charitable donations are not enough to sustain an organization where the end-goal isn't really charity, imho.
As far as code and prod is concerned, IV itself is not PROD as an organization just yet. We're a loosely-knit community of folks who want to work towards a common goal for out own benefit.
If 25,000 or whatever number we're at pay/contribute/donate (whatever you want to call it) 20/50/100 $/year for "membership", we'll have a better shot at going "PROD", sustaining the infrastructure and the spirit.. and perhaps achieve our goals, imo again. :)
jazz
This is how You release code to PROD? no user testing at all?
and the entire paid thing is the beginning of the end. not good.
why didnt we even have a poll on this? crazy crazy idea.

am I the only one who noticed that they admitted that although FIFO is a nice idea, it's impractical (for them) and that it's NOT how they do it (but it's written all over their literature) ?
what I got from it is: they are overwhelmed, they have not real idea of what is going on in the offices and how much it cost for the agency and the country to push people out.

I agree with the above posts, they are stealing money by having stupid charges. Why do you need to charge a customer Rs.400 for changing his account password. It is absolutely ridiculous! Compare that to a bank in US, you just go online and change the password. Also, they have 2 passwords one called Account password to login to the account and another called Transaction password for making any transactions. So the more number of passwords you have the more you tend to forget either of them and they can charge you Rs.400 for each password reset!

This link which is giving prediction for Oct, 2007 looks totally off to me.
if you see his EB3 predictions he is saying it will be close to to Jan 2007.
Where in Jan 2007 EB3 China was Aug 2002 not April 2005.
Don't know what is the reasoning behind these predictions.
Dude, HE says dates of Jan 2007 not date being Jan 2007. So the PD will be Jan8, 2003

To all RonGcher fans:
Where is your RonGcher now?
He predicted a heavy forward movement of dates in the last quarter.
You thought he knows more and has inside information? :)
Now you know these lawyers are out there just to market themselves and get more clients.....
He was going by the logic that apparently DOS was releasing visa numbers on a quarterly basis. It should be clear now that it is not true. DOS is no longer releasing visa numbers on a quarterly basis.
Ron Gotcher does not have a crystal ball. He was predicting based on past statistics. It was subject to the condition that DOS had not changed its model.

Irrespective of the employer decision to revoke I140 or not, I have to send AC21 letters to USCIS. That is the reason I am asking anyone to suggest a good attorney for representation.
Not to scare you but you sure your current employer will not revoke 140, look at the recent experiences from people.

One word answer:
Y2K
So AC21 and visa recapture happened without anyone trying for it.
They increased quota of H1B, did AC21 because it was a market demand.
Now the economy is down, there are elections, jobless rate is high............ so think why will they increase h1B quota or greencard quota? What is the incentive for government?
I have always held that asking for quota increase is a bad idea and will not happen.
Visa recapture is the best bet and even that appears to be a hassle as there are many factions opposing it.

good topic and reply.
Maintaining GC is a big hassle you have to return every year (2years for the first time i think). Couple of Infosys blokes (with GC) that i know had discussed this with the company before joining and the company sent them within 2years on a short term projects to the US.
If you have a US citizenship then you can opt for a dual citizenship. That might help you get a job directly in India (dont know the rules, just guessing)
This thread is long time coming, and thank you for starting this. This is a question often discussed in friend circles, but most people I know hesitate to take a position. I think the anonymity of this forum will let us express ourselves more honestly...
When I came to the US 6 years ago, I had deliberately made the decision not to decide in the first couple of years about staying on or returning back after sometime. I had seen too many friends and relatives who all said "don't worry, we'll back in a couple of years" and never made it back. Marriage, kids, school, house, GC...Citizenship...it kinds of gets on you. And before you know, your kids are making the decision for you. I know of a couple of families with grown up kids who moved back to India only to move back to US because the "kids could not adjust". It's not hard to read between the lines that "we also could not adjust".
As days go by, it is becoming more clear everyday that I will also return back one day, sooner rather than later. I have some questions that haunt me:
- if/when I get my GC, and if I return back, is there a way to hold on to the GC status?
- if someone has a US citizenship, when companies such as Infosys hire them, do they have to get a work visa or something? Is there a concept equivalent of H1/GC for non Indians yet?

It is very easy to contradict or find errors.
No body is getting paid here to have a tester test it.
Yes I like the idea of donor for paid members. There are 31000 members not even 2500 members are contributing. This is one way of making them pay for the services or the info you get from the forum.

The USCIS automated line for Priority dates is still playing the PD's for June 2007 showing that EB India cut off June 1st 2003 etc..
We have so contrasting images of the efficiency of USCIS. Hope they keep the same tempo as of the last week of June on Oct 1st when the FT 2008 quota kicks in.
I think we should all chill and not worry what is going to happen. Have a beer. Say Happy Birthday to GW Bush. if the visas are over there is nothing USCIS can do. They cannot generate numbers automatically. So chill everyone.

hpandey,
I do not buy this argument because how come NSC is approving peoples I-140 filed concurrently in July-Aug 2007 or even non-concurrently filed as late as Oct 2007? How come Eb2 is moving so fast in NSC ?
How come Eb2 and Eb3 for Non-concurrent filers in TSC is moving so fast ?
They have taken some deliberate steps internally not to process certain applications - which is Unfair and Illegal from a USCIS FIFO perspective and that is what we are trying to Protest professionally.
Let me know what you think !
Looks like the USCIS had been busy with the citizenship applications before the Nov elections and hence it has been slow approving I-140's and GC's. Now that it is coming to an end we might see our applications moving forward. Maybe from Nov onwards it would be better.
