A new poll from Benenson Strategy Group (commissioned by America's Voice), has a surprising finding - the vast majority of self-identified GOP voters support immigration reform. In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

I received RFE that says" your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
I did TB skin test in 2007 that came negative and it appears to me, civil surgeon did not updated results on I-693 form. After consulting with the doctor they filled up new I-693 from with 2007 test results and gave me in a sealed envelop. I need to know whether 2007 results will be acceptible to USCIS or do I need to do it gain before I submit response. Please advise.

Let the EAD expire, it makes more sense to use H1B when you enter the country. EAD and Advance Parole should be avoided and be used only as a last resort in extreme cases beacuse of the way immigration rules are carved.

My friend John Lamb is an in house corporate lawyer by day and an immigration reform activist in his spare time. Maybe the fact that he's outside the immigration law world gives him some room for thinking outside the box since he's often coming up with creative approaches to changing immigration law. Hi,
I am asking this for my sister who is working under J1 (start in October 2007 and valid for 1 year). She already get a J1 visa stamp and re-enter US as J1 status
1. Change of employer is not permissible in J1. Can she submit a new J1 petition and thus ending her current J1 petition early?
2. How about the 2-year home residency requirement (HRR)? Does she need a waiver for the current J1 she is doing now OR can she satisfy the HRR after she finishes with the new J1? The new J1 will not end later than the current J1. So, practically she will be in J1 for 1 year only.
3. Does she need to get another J1 visa stamp and re-enter the US?

You can even take an unpaid job/volunteer to keep you clear of the 90 days unemployed clause.
I didnt know that even the OPT rules have changed now. This is a mess.
Now OPT also you cant remain unemployed for more than 90 days. Now this OPT is becoming like another H1B.

Hi
I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
Any idea ?
I gave my Fingerprints also. So far i did not see any LUD. I dont know what they are doing. Simply ignore it. There is nothing to do ourside.

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional
Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?
