We got something similar. I have seen other posts in the forums but can't find them now. I would suggest you go for the fingerprints/biometrics and be done with it. Don't give them an excuse to actually implement "if you don't show up, your application will be considered abandoned".

Hello Gurus,
Can we apply for H1 if our I-485 is pending while the current status is L1.
The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:
Will there be any impact or no impact at all?:mad:
Is there an option to apply without asking for COS when applying H1 with the current status as L1.:confused:
Please help with your views....

July/Aug-07 filer for I-485 at NSC. Applied for EAD Feb-end and Received EAD in the mail last week. Noticed that the validity start date is 3/24/2007 and end date is 3/23/2009

Hi All ,
I am currently on L1B visa valid till Dec 25 2008 and current I-94 valid still July 2009.
I can't apply for I-94 extension until Jan 09.
I am travelling to india on Nov and will return on Nov 30 2008.
Is it advisable to go for Visa Stamping during Nov 08 or can i file my extension once i returned back to US on NOv 30 2008.My visa will be valid only for 25 days and want to know if that will create any issues.
Any views would be greatly appreciated.

Hi friends,
I got my I-140 approval in premium processing. But unfortunately, USCIS printed the new labor filing date (2010) when the attorney requested my I-140 to capture the old priority date which is June2004. My law firm already contacted USCIS to issue a revised notice with the old priority date (June2004).
How long does USCIS take to issue a revised I-140? Any feedback is greatly appreciated. Anything that we can do to expedite the release of the new I-140 notice with correct priority date?
Please let me know when you get a chance

Please submit contracts, statements of work, work orders, service agreements or letters from/with end-client firms requiring computer related services of the beneficiary. Evidence from other consultants or employment agencies not acceptable. The requested evidence should show specialty occupation work with the actual end-client company where the work will ultimately performed.
My company is big (250+) so why such?? if somebody had same RFE or any guidance or help regarding such matter is higly appreciated.

Hello,
I am not sure if this is good place to ask this.
1. I have moved out of US 5 months ago and I am working for my GC sponsoring employer overseas. What happens to my I-485? Is it considered abandoned?
2. While I was working as H1 I contributed to 401K. I want to know if I can leave that money in the US till retirement age and then start widrawing while living overseas. I expect I will not be a US citizen at that point.
Can anyone point me to a competent accountant who can help with question 2?

its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?
