A reader sent me a link to a post at the The Future of Capitalism blog reminding folks that being pro-immigration fits right in to a conservative agenda: David Cameron, the British "Conservative" Party leader who favors a top income tax rate of 50%, also wants immigration restrictions that would limit Great Britain's population over the next 20 years to 70 million. What kind of an audio file are you going to be playing? Will it be something like a sound loop?

I've been blogging about this for years, but the GOP still can't see that its tilt to being the anti-immigrant party is incredibly dangerous for its long-term prospects. Hi,
My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.
I appreciate your response.

You can apply again if you have a new employer, or even if the same employer will reapply. However, if you were denied for a reason that is still a problem, such as not having the required degree or experience equivalent, there is no point in reapplying. Good luck.

I see thread for all other years (2003, 2004, 2005, 2006 and 2007). So its my turn to open thread for my year.
Mine is EB2, Feb 2002. Still waiting. I was told that my NC is cleared.
3 SR, 2 letters to Ombudsman, letters to 3 senators, letters to 2 representatives, 2 fax to NSC, 2 letters to NSC Director, 1 infopass, numerous calls to NSC
Recently sent a letter to first lady. Looks like all of them are working together. Nobody wanted to respond.
Please feel free to write your experience if you are 2002 filer.

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. As of July 10, 2009, U.S. Citizenship and Immigration Services (USCIS) had received 44,900 H-1B cap-subject petitions that have been counted towards the 65,000 H-1B cap. As the title says, can I change from AOS to CP even though my PD is not current.
Will the consulate process my case even if the PD is not current ?
I guess, they should depending on the number of applications at the consulate.
Please let me know whether I should take this route.
Well my PD is Feb 2007 (EB2) so I was thinking of this route rather than wait for endless years in this mess :(

Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

Dear Attorney,
i would like to join a very good opportunity on EAD but have one concern shown below.
"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"
Your advice will help me alot and would be really appreciated!!!!

Is the PERM sponsorship email sent from DOL to the HR representative of the company automatically generated or is it sent after manual review of the application by the authorities?
Out first PERM application was denied and the attorney refiled it again on the same day saying it was because one colum was not filled in.
We refiled on last friday and still havent received the sponsorship mail this time too. Again the attorney tell us it is possibly because monday was public holiday.
I was under the impression that the sponsorship email is automatically generated as long as all the info is correct.
Any idea if the attorney is right on this?

I have filed the H1B(I129) transfer and extension on H4(I539) in the month of June 18th and then upgraded to premimum process in the month of November, after 2 days it got approved and within the next two days they changed the status to RFE and requested to send the paystubs for the past 3 months. I have all the paystubs and our attorney sent the response with the paystubs to USCIS. In between this my wife travelled to India when my I129 and I539 pending.
1) Do you think there will be any problem for my visa to be approved(since my wife is in India)?
2) Can my wife visa gets approved when she was in India?
3) How long do they take to respond to the RFE?
Please advice.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.
