Guys
Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.

Hi Friends,
I have been cheated by a desi consulting company e-Data experts located in Harrisburg, PA. They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. Can someone help me out how to sue the company for not revealing the information and firstly how can I stay in the country. BTW I have done Masters here and I am with another company now. Appreciate all your suggestions.

Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?
Is itbetter than applying 485 here and waiting .......ZZZZzzzzzzzzzzzz
Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

Most people have now heard about Stephen Colbert's testimony in front of the House Immigration Subcommittee this week on the subject of new laws for migrant farmworkers. Some have criticized the Committee for letting the comedian speak. I say, how high can the standards be if they let me testify? Hi all,
My I-140 was approved 2.5 years back and I-485 was also approved more than an year back.
But, today the status on my I-140 got changed to "REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD". I am not sure, why did they reopen the case again. I checked with my company and they assured me that they didn't revoke my I-140.
Could anyone suggest me what's happening to my case. Has anyone seen an similar kind of an issue and wat shd I do further ?
