    Do you think that I140 PP process will resume now since USCIS is not accepting any I485 applications until Oct 2007 ???

    Depends on what is written in your LC job requirements. If it is either Masters or BS + 5 yrs of experience, then - yes, you can file I140 in EB2.

    Otherwise, you will have to file a new labor.

    On I-765 item# 11 it asks us "Date". Which date are they referring to? Cause I had applied for OPT EAD twice (duration of 6 months each). Can someone pls let me know.....


    Put the last date of OPT EAD receipt and send in both the copies of EAD(very very important).

    sorry, posted this under wrong category I don't know how to delete it.

    I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
    my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)

    if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???

    Please advise. Thank you

    Hi
    My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.

    Please clarify these doubts:
    When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?

    Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?

    If the F2 application is pending, is it possible to reapply from F2 back to H1B?

    Any help will be greatly appreciated.

    Hi,

    I have entered in US with a H1B of company A. I got it transferred to company B in Nov 2008 and got it approved .. i have I797 and I94 valid till Dec 2010.
    In May 2009 I have initiated H1b transfer with company C and today I came to know that it is denied. I dont know the reasons yet.
    Can any one suggest what are my available options.
    Can I initiate transfer with another company with the 1797 of the companyB

    USCIS has announced revised filing instructions for numerous petitions, including its Form I-140 (Immigrant Petition for Alien Worker), Form I-130 (Petition for Alien Relative), and Form I-539 (Application to Extend/Change Non-Immigrant Status).     Could someone tell me please.....I'm filling the application for advance parole the first time......what should I write where it is written: " Date of intended departure"...if I dont know exactly when I'm leaving....should I write a date or should I write " I dont know yet?"

    And also I read that the documents required are 2 photos, I-485 receipt notice, I-140 approval notice.....is that right? or what other documents do I need?

    I would highly appreciate your help!

    Current situation :

    Labor approved(eb3 with pd of July 03),
    I140 in process,
    In my seventh year of H1b on a one year extension expiring in August.


    Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?

    I did my MBA in one of the premium universities in USA.
    I applied for H1-B in FY 2008 under master quota from a small consulting company.
    I left US on 30th Sep 2008 as I didnt get an approved petition by that time.Hence I never worked on that approved H1-B petition
    I got a approved petition. I went to New Delhi consulate for H1-B stamping. However I got a Blue 221 G slip. I never submitted any document as the consultant who applied for my visa , needs lots of time to process the documents. In the mean time I got another offer from one of the fortune 500 companies in USA. I am just exploring the possibility of H1-B transfer in this case. Ofcourse they will file a new H1-B application but would I be cap-exempt in this case?
    Please help!!

    Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.
