MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.
What are the limitations in this path. Do we always have to be in USA on valid H1B.

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B extension plus recapture
time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.

Can someone get GC’s without reaching the priority dates?
I don’t have much information but I heard the following by mouth. My friend told me that he came to know a person(Indian) who had got his GC without the priority date being current. His prior status was EAD. If it is real, is this a fluke case?
I know many people applied for I485 in 2005 Sep, and PD was also from that year, and got the EAD’s. So do they have priority of getting GC than people who had PD dates prior to 2005 but not filed for I485?

The bill would grant two-year visas to entrepreneurs if they secure $100,000 from qualified investors. After two years, the start up must have at least five employees and $500,000 invested. Democrats and Republicans have talked endlessly that the focus in Washington should be on job creation, but for the most part little has been done. The start up visa is a way to directly create jobs and costs the taxpayers nothing.

Hi, My wife has started working on EAD as an individual contract employee and her employer is asking to complete W9 form. But in the form it says that only US citizen can complete that form. Also it asks for backup withholding. I am not sure what it is.
I am confused now. I know that EAD has no restriction in employment. Pl. help.

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.

I filed for PERM with PD of October 2007 in Atlanta center under EB2 category for Sr.Software engineer position. As we know it is still in PENDING status after a AUDIT request.
Now, I have received an offer for a Sr.Technical Program manager internally in my company.
What are my options now?
1. Can I withdraw my current PERM (while it is PENDING after AUDIT) and apply for a new PERM under new position? OR
2. Can I use the same PERM since I'm staying with the same company?
3. Does the company size help in any way?

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?
