First of all I am filing by postal mail USPS(not e-filing)
1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
2) for AP renewal is it necessary to include marriage certificate for spouse
3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my AP renewal
4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address
IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.
Any clarification is highly appreciated

I am not fully aware of all the benefits of having EAD after filing 485. If you have the knowledge about it could you please list down it in this thread.

as of now it lets the spouse to start working.. & then the not too fancy AC21 portability.. Advanced Parole for trvael outside the US etc..
in terms of GC its just another waiting phase..

In 2007 , I joined a new company and filed my Labour substitution+I140 petition in June 2007. This got approved in November 2007. but my H1B transfer to this company is still not approved. Earlier this year (2008) I went back to my previous company whose H1B is still valid and waited for my old H1B to get approved with no luck.
Now, i wish to start my GC process with this new company, can I retain my old priority date of I140 ? There is absolutely no chance that I will get I-140 approval copy from my old employer, but I have the receipt Number and I know the PD.
Any help is appreciated.

I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.
1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?
Awaiting for feedbacks.

We filed a H4 to H1 Change of Status petition for my wife. The file was opened and processed by USCIS and a RFE was issued. Due to some family situation, we had to withdraw the H1 petition instead of replying to the RFE.
My question is: Is the security/anti-fraud fee ($1500) returned by USCIS in such cases. We applied through a big consulting company.

On the same basis, I did my MBA from University of New Haven, CT USA. Now as I wan to file my H1B on the basis of my AMIE qualifiactions, what would be your wise advice?

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?

If I file my I-485 through my lawyer, will I have to be with him for all subsequent EAD/AP renewals as well or can I renew them on my own?

FP done on - Oct 24, 485 LUD was 24 Oct.
Nov 3 - one more LUD on 485 app for me and spouse.
: BEC LC cleared on June 21, PD march 2001, I 140 + 485 filed on July 2 for me and spouse.
What do you make out of the two LUDs in less than 2 weeks ?.
My I 140 is still pending. (EB2 Category)

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform?
